CONDITIONS OF HIRE

Lambert Locations Pty Ltd is engaged strictly in accordance with the following conditions and the client in so engaging Lambert Locations Pty Ltd agrees to the conditions. 

All underground utility service locations are carried out in accordance with quality levels described in AS 5488 and must be potholed for verification.

  1. The client is solely responsible for meeting duty of care obligations with respect to the location of any underground services, including but not necessarily limited to:
    1. observing the "four P's" of safe digging, namely plan, pothole, protect and proceed; and
    2. observing and complying with any and all workplace health and safety legislation and other statutory requirements.
  2. The client is responsible for:
    1. requesting plans from the relevant service provider (e.g. Telstra, Energex, Local Council) for each underground service that is to be located by us with respect to the site;
    2. providing the said plans to us prior to the survey of the location; and
    3. visually locating the underground service by manually hand-digging or using vacuum hydro excavation (potholing) for verification as per AS 5488 and where any construction activities may damage or interfere with the service providers plant.
  3. We will use our best endeavours to assist the client in the location of the services, based upon the plans provided by you, by us or by others and will offer guidance as to the location of services.
  4. We will not be responsible for any inaccuracies in the plans provided to us or in the event that the plan does not cover the site in its entirety (e.g. private property).
  5. The client shall be responsible to any Public Authority or Public Person or Company in relation to any damage caused by our equipment or the equipment of the client and in this regard, the client acknowledges that such damage can include, but not necessarily be limited to personal injury, property damage and business interruption of the service providers’ business.
  6. The client agrees to abide by the Minimum Clearance Guidelines as specified by the relevant service provider and acknowledges that a copy of these guidelines are available from the service provider with the Dial Before You Dig plans provided.
  7. We will take all due care with regards to the location of services within the areas advised by the client. However all responsibility remains with the client and no warranty, whether expressed or implied, is given in the event that we are unable to locate a service or services which is or are damaged in any way whatsoever.
  8. The client acknowledges that electronic detection will be carried out to the quality levels requested as per AS 5488. Electromagnetic Radio Frequency devices may be affected by other influences. Some services are untraceable, because they are for example, optic fibre cables, pvc piping or other non-metallic materials. In these instances, the provisions of clause 7 apply.
  9. The client agrees to indemnify us and keep us indemnified against any and all actions, suits, claims, damages or loss sustained by or brought against us either directly or indirectly as a result of any breach by you of this agreement or as a result of any damage caused by you to any service, or to any person, as a result of your actions involving the services in any way whatsoever.
  10. If our trading terms of seven days are not honored all unpaid invoices are subject to a monthly late payment fee of 2% of the overdue balance (excl GST) or a monthly flat fee of $60 (excl GST) whichever is the greater.
  11. An administration fee of $60/invoice (excl GST) will apply if an order number is required by your company and not supplied to Lambert Locations within one week of procurement of our service.
  12. The client acknowledges that it has received these terms and conditions and has read and understood them
